Can a midget racer use a much stronger motor than designed for and can it be licensed in California?

I have found many plans for midget racers on the internet and I’m quite fascinated with them but since they were made from the 20s-50s almost all of them call for the Maytag washing machine motor.What I would like to know is that if I were to build one could I safely use a 6.5 hp or a 2.5 hp motor in it or would it be dangerous since the racers were designed for a 1/2 – 3/4 hp motor? And is it any way possible that such a thing could get licensed in California? I have seen some bigger ones that use a motorcycle engine that I feel have a better chance at getting licensed but I’m interested in the real small ones.
